{"id":2190,"date":"2025-02-07T23:24:35","date_gmt":"2025-02-07T23:24:35","guid":{"rendered":"https:\/\/air-vote.com\/en\/?p=2190"},"modified":"2026-01-17T18:10:55","modified_gmt":"2026-01-17T18:10:55","slug":"new-ontario-regulations-on-service-records-in-public-washrooms","status":"publish","type":"post","link":"https:\/\/air-vote.com\/en\/blog\/new-ontario-regulations-on-service-records-in-public-washrooms\/","title":{"rendered":"New Ontario Regulations on Service Records in Workplace Washrooms"},"content":{"rendered":"\n<p>Ontario&#8217;s&nbsp;<a href=\"https:\/\/www.ola.org\/en\/legislative-business\/bills\/parliament-43\/session-1\/bill-190\" target=\"_blank\" rel=\"noreferrer noopener\">Bill 190,&nbsp;<em>Working for Workers Five Act, 2024<\/em><\/a><em>,<\/em>&nbsp;amended the <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/90o01\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Occupational Health and Safety Act<\/em><\/a>&nbsp;(OHSA) to add new washroom facility-related requirements for employers and constructors on construction projects. Specifically, these covered entities must ensure that any washroom facility they provide for workers are maintained in a clean and sanitary condition, and that they keep, maintain, and make available records of the washroom facility&#8217;s cleaning. This amendment will come into force on&nbsp;July 1, 2025.<\/p>\n\n\n\n<p>On November 29, 2024, Ontario filed the following clarifying regulations, which will come into force on&nbsp;January 1, 2026:<\/p>\n\n\n\n<p><a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/r24480\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation 480\/24 \u2013&nbsp;<em>Washroom Facilities \u2013 Records of Cleaning<\/em><\/a>&nbsp;(Regulation #1)<\/p>\n\n\n\n<p>Regulation #1 clarifies that an employer and constructor can meet their obligation to make washroom cleaning records available by ensuring that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the record is posted in a conspicuous place in or near the washroom facility to which the record pertains where it is likely to come to the attention of workers; or<\/li>\n\n\n\n<li>the record is posted electronically where it can be accessed by workers, and workers are provided with direction on where and how to access the record.<\/li>\n<\/ul>\n\n\n\n<p>Regulation #1 also provides that this record must include the date and time of the two most recent cleanings of the washroom facility.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.ontario.ca\/laws\/regulation\/r24482\" target=\"_blank\" rel=\"noreferrer noopener\">Regulation 482\/24 \u2013&nbsp;<em>Washroom Facilities \u2013 Construction Projects<\/em><\/a>&nbsp;(Regulation #2)<\/p>\n\n\n\n<p>Regulation #2 amends&nbsp;<a href=\"https:\/\/www.canlii.org\/en\/on\/laws\/regu\/o-reg-213-91\/latest\/o-reg-213-91.html\" target=\"_blank\" rel=\"noreferrer noopener\">O. Reg. 213\/91 (Construction Projects)<\/a>&nbsp;under OHSA by revoking s. 29(12) and substituting a new s. 29(12). The new s. 29(12) requires a constructor to keep a record of the servicing, cleaning and sanitizing services of any toilet, urinal, and clean-up facilities. It also stipulates this record must include the date of all services for the past six months or the duration of the project, whichever is shorter.<\/p>\n\n\n\n<p>Accordingly, effective January 1, 2026, a constructor will be required to satisfy its obligations under both Regulation #1 and Regulation #2.<\/p>\n\n\n\n<p><strong>Bottom Line for Employers &amp; Constructors<\/strong><\/p>\n\n\n\n<p>Now that in-force dates are known and regulations have been published, employers are encouraged to review and amend their workplace policies and procedures, and constructors on a construction project are encouraged to review and amend their policies and procedures for project sites to satisfy their upcoming washroom facility cleaning and recordkeeping obligations under OHSA (effective\u00a0July 1, 2025), and their upcoming posting and recordkeeping obligations under Regulation #1 (effective\u00a0January 1, 2026).<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>OHSA cleaning and recordkeeping requirements begin July 1, 2025, followed by Regulation #1 posting obligations on January 1, 2026.<\/p>\n","protected":false},"author":1,"featured_media":2193,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"content-type":"","footnotes":""},"categories":[4],"tags":[],"class_list":["post-2190","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-blogs"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v14.9 -
